<br />The State: of Colorado and thc State of New Mexico, desiring
<br />to provide for: the equitable distribution of the waters of the La
<br />Plata Hiver and to remove all causes of present and future con-
<br />troversy betwL'Cn them with respect thereto, and heing moved
<br />by considerations of interstale comity, pursuant to Acts of their
<br />respective Lel\islatures, havc resolved to conclude a compact for
<br />theoe purpOl!e~ and have named as their Commissione1'll: '

<br />Delph K ,Carpenter, for the State of Colorado; and Stephcn
<br />B. Davis, Jr., for the State of New Mexieo; who have agreed upon
<br />the followiug ,Articles.:

<br />ARTICLE I
<br />
<br />The Stat~ of Colorado, at its own expense, shall estahlish and
<br />maintain two permanent slream-gauging stations upon the La
<br />Plata River fbr the purpOI!e of measuring and recording its !low,
<br />which shall h~ known as the Hetlperus Station and the Interstate
<br />Station, resMctively.

<br />The Hel!~erus Station shall be located at .ome convenient
<br />place near t~e village of Hesperus, Colorado. Suitahle deviccs
<br />for ascertaining and recording the volume of all diversions from
<br />the river aboye Hesperus St.atlon shall be established and main-
<br />tained (with1ut expense to the State of New Mexico), and when.
<br />ever in tbis c\lmpad reference Is made to t.he flow of t.he river at
<br />Hesperus Station, it shall be constrned' to inclnde tbe amount of
<br />the concurreqt diversions above Il8ld station.

<br />The Interstate Station shall be located at some convenient
<br />place within rne mile of, and ~bove or below, ~he interstate line.
<br />Suitable devices for lUleertain1ng and recordmg tbe volume of
<br />water dlvertell by tbe Enterprioo and Pioneer Canals, now serving
<br />appl'Qxima.teljy equal areas in both Atates, sball be established and
<br />....Intalned (lwlthont expense to the State of New Mexico), aud
<br />whenever in !this compact reference Is made to the flow of the
<br />river a.t the Irite!'l!tate Station, it shall be construed to Include one-
<br />half the volulne of the concurrent diversion. by such canals, and
<br />al80 the vol~me Qf any other water which may hereafter be di-
<br />verted from ~d river in l",olorado for ulle in New Mexieo. '
