<br />"^ <br />I' <br /> <br />00177t, <br /> <br />with established procedures used by the <br />Bureau of Reclamation to classify the <br />iITigable land on a project whereby eco- <br />nomic factors such as productive capac- <br />ity of the land, taking into consideration <br />cropping limitations imposed by latitude <br />and climate. farm production costs and <br />land development costs. are correlated <br />with physical factors such as soil, toPOg- <br />raphy; drainage and quality of water. <br />(b) Class 1 equivalency factors are de- <br />termined by comparing the productive <br />potential of class 1 land, under average <br />. management. with the produCtive po:-- <br />tentia.1 of lower class land so as to quan- <br />tify the relationship of an acre of class <br />1 land to an acre of each of the lower <br />classes of land in the project. (1) Class <br />1 equivalent acr,eage is determined <br />through the application of factorial <br />equivalents that will approximately <br />equate the of_arm unit acreage of land of <br />lower economic prOductivity to the eco- <br />nomic productivity potential of class 1 <br />land. Factorial equivalents based on <br />physical and economic criteria shall be <br />determined by the Secretary. For exam- <br />ple, class 1=1, class 2=.8, class 3=.6 and <br />class 4=.5, or .8, .6 and .5 acre of class <br />1 land equals 1 acre of class 2, class 3 and <br />class 4 land respectively. <br />(c) -An individual's nonexcess entitle- <br />ment using the class 1 equivalency con- <br />cept, if authorized for a project, will be <br />determined on the basis of his landhold- <br />ing in each land class. Nonexcess acreage <br />of irrigable land classes below class 1 <br />shall be determined -through class 1 <br />equivalency factors on the -basis of the <br />acres of such lower classes in excess of <br />160 acres which are necessary in <br />weighted total acres held in single own.,. <br />ership to be equivalent to the acres- of <br />class l' determined by the Secretary' as <br />adequate to support a family and, pay <br /> <br />PROPOSED RULES <br /> <br />water charges. The nonexcess entitle- <br />ment of a landowner will be designated <br />by the landowner, district or the Secre- <br />tary in accordance with established pro- <br />cedures set forth in standard languag~ <br />Uf)ed for water service and repayment <br />contracts. The nonexcess entitlement <br />designation may consist of a combination <br />of the acreage of each land class as de- <br />termined when the designation is made <br />and may not be revised unless prior ap- <br />proval is given by the contracting officer. <br />(d) Class 1 equivalency can -be used by <br />a district only if its repayment or water <br />service contract with the United States <br />is amended to incorporate provision for <br />the use Of the class 1 -equivalency con- <br />cept as authorized by law. <br />(e) Class 1 equivalency factors that <br />are established for a district will be pub- <br />lished in the FEDERAL REGISTER at least <br />60 days prior to their application to lands <br />of the district. <br />ti 426.14 Decisions and appeals. <br />The Regional Director acting as des- <br />ignee of "the secretary shall make the <br />determination required under these <br />rules and regulations. A party directly <br />affected by such determination may ap- <br />peal in writing to the Commissioner of <br />the Bureau of Reclamation within 30 <br />days of receipt of the Rei:tional Director's <br />determination. The affected party shall <br />have an additional.30 days thereafter <br />within which 'to submit a supporting <br />brief or memorandum to the Commis- <br />sioner. The Regional Director's deter- <br />mination will be held in abeyance until <br />the Commissioner has reviewed the mat- <br />ter and 'rendered a decision.
