<br />ti. 426.1 Objectiyes.
<br />The Reclamation Act policies of limit-
<br />ing the area of land for which project
<br />water may be supplied and requiring the
<br />landowner to reside on or in the neigh-
<br />borhood of the land 'benefited are de-
<br />signed:
<br />(a) To provide opportunity for a
<br />maximum number, of "farmers on the
<br />land.
<br />(b) To distribute. widely the benefits
<br />from pUblic-supported reclamation be-
<br />cause interest-free. money and low-
<br />priced water are involved.
<br />(c) To promote the family-size owner-
<br />operated farm.
<br />(d) To preclude the accrual of specu-
<br />lative gain in the disposition .of excess
<br />land.
<br />~ 426.2 Effective date, applicability.
<br />(a) These regulations shall become
<br />effective upon publication in the FEDERAL
<br />REGIS'IER as final rulemaking.
<br />(b) These regulations apply to all
<br />existing excess lands, including those
<br />now under recordable contract. Among
<br />other things, they define, consistent with
<br />but with greater specitlcity than existing
<br />recordable contracts. both those persons
<br />qualitled to purchase excess lands (as
<br />provided in standard recordable con-
<br />tracts) and those procedures to be used
<br />in disposing of excess lands. These regu-
<br />lations shall not apply to existing repay-
<br />ment, water service and recordable con-
<br />tracts only to the extent there is a clear,
<br />specific and irreconcilable conflict be-
<br />tween these regulations and existing
<br />valid contracts which are not otherwise
<br />inconsistent with the reclamation laws.
<br />(c) Persons who own lands (1) served
<br />by more than one Federal project sub-
<br />ject to reclamation laws or (2) located
<br />in more than one district, the total of
<br />which exceeds the acreage. limitation,
<br />shall have one year from the effective
<br />date of these regulations to sign a re-
<br />cordable contract for the sale of excess
<br />lands, in order not to interrupt delivery
<br />of Federal water to thes9 lal.lds.
<br />~ 426.3 Authority.
<br />These regulations are promulgated
<br />pursuant to authority vested in the Sec-
<br />retary by Congress in the AdminiStrative
<br />Procedure Act. 60 stat. 237, 5 U.S.C. 552,
<br />553, and the Reclamation Act of 1902, as
<br />amended and supplemented, 32 stat. 388,
<br />43 U.S.C. 371 et seq. The basic require-
<br />ment that the Bureau of Reclamation
<br />limit the' sale of water rights or the de-
<br />fivery of project water to tracts of not
<br />more than 160 lrrigable acres was ini-
<br />tially contained in the Reclamation Act
<br />of June 17-, 1902. and is. with compara-
<br />

<br />tions or exceptions for particular proj-
<br />ects' applicable to all reclamation-served
