Forum an4 Work Group Members

SALINITY LEGISLATION

On December 30, 1982, by MEMORANDUM 82-104, the Forum and Work Group
members were provided with the Administration's positions concerning S. 2202.
I have since discussed several points made by the Administration with some
members of the Work Group and the Forum. I intend to discuss the impacts of
the requested changes further with basin states and federal officials over the
next week. Myron Holburt plans a trip to Salt Lake City on Monday, January 17,
and we will be discussing these requested changes and the possible need for
Work Group attention to some of these matters. .

Following is a rather lengthy and"somewhat detaile4 analysis of the
Administration's requested changes to the legislation. Let me first summarize
my conclusions. I believe there are only four major issues which may require '
Forum policy. They are:

1. Cost sharing - paragraph 11 below
2. Authorization of salinity units before feasibility studies
are completed - paragraph 2 below
3. Authority the governors and Advisory Council may be given
to review the ongoing programs without encroaching upon
the powers given to the federal government by the
Constitution - paragraph 8 below
4. Requirement that a ceiling be imposed in the expenditure
of funds for the Department of Agriculture - paragraph
9 below

I believe it would be to the Forum's advantage to have the legislation
introduced as quickly as possible, exactly as it was prepared last year, and
then allow the rorum to address its position on various changes to the leg-
islation prior to hearings. I have felt this was the general feeling of the
Forum. Chairman Christopulos has requested that I call a Forum member from
each state to see if they concur in this approach. After the introduction of
the legislation, I recommend that a special short Forum meeting be held at some
convenient location to resolve the Forum positions on these four issues.
